Important notice for all drivers and transporters!

We’re entering the “silly season” where traffic officials seem particularly motivated to fill their holiday coffers. Law enforcement agencies across the country may be looking for opportunities to issue fines or request bribes from drivers under the guise of fabricated traffic offences.

As Mike Fitzmaurice, executive director of the Federation of East and Southern African Road Transport Associations (FESARTA), notes: “We are now getting daily reports of driver harassment for made-up traffic offences with the intention to bribe the driver or transporter.”

Fitzmaurice shares the following advice on how to deal with the situation:

1. KNOW YOUR RIGHTS:

– You can ask to see the section of the Act related to the offence they’re citing. If they refuse to show it, the offence doesn’t exist.

– Threats to impound vehicles or confiscate licence discs, passports, or other documents are illegal.

– Drivers and transporters are legally permitted to video record conversations with traffic officers and take photos of the officer’s vehicle, number plates, and name badge.

2. STAY CALM AND STAND YOUR GROUND:

Instruct drivers to remain polite and avoid raising their voices or arguing, as this can escalate situations. Remind them to be respectful but assertive – don’t let officers intimidate you.

3. REPORTING ISSUES:

If you or your drivers encounter harassment, report the incident with as much detail as possible, including:

– Nature and location of the incident

– Driver’s contact details

– Officer’s name, rank, and vehicle information

– Photos and, where possible, video recordings of the interaction
